Terms governing FEA services

These Terms & Conditions govern access to and use of the Facility Excellence Assessment (FEA) website, assessment services, reports, certification services and related information.

By accessing this website or engaging FEA services, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

Definitions

For the purpose of these Terms & Conditions, "FEA", "we", "us" or "our" refers to Facility Excellence Assessment and its authorised representatives.

"Client", "facility", "you" or "your" refers to the organisation, facility owner, management, representative or authorised person engaging FEA services.

Use of the Website

The FEA website is provided for general information regarding Facility Excellence Assessment, its methodology, services, certification framework and related activities.

Users agree to use the website lawfully and responsibly and shall not attempt to interfere with its operation, security, availability or functionality.

Assessment Services

FEA assessment services are conducted according to the applicable assessment scope, methodology and criteria agreed with the client.

The assessment may include physical inspection, observations, interviews, document review, evidence collection, scoring and benchmarking.

The exact scope of an assessment may vary depending on the type, size, complexity and operational characteristics of the facility.

Client Responsibilities

The client is responsible for providing reasonable access, cooperation and information required for the assessment.

  • Providing access to relevant areas of the facility.
  • Providing accurate and complete documents and records where requested.
  • Making relevant personnel available for interviews or discussions.
  • Informing FEA of known hazards, restrictions or special conditions.
  • Ensuring that assessment activities can be conducted safely.

Accuracy of Information

The client agrees to provide information and documentation that is accurate, complete and not misleading to the best of its knowledge.

FEA may rely on information provided by the client when conducting an assessment, preparing reports or determining an assessment score.

Assessment Scoring

Assessment scores are determined using the FEA scoring framework applicable to the relevant assessment.

The score reflects the facility's observed performance against defined assessment criteria at the time of assessment.

FEA reserves the right to update, improve or revise its assessment methodology and scoring framework.

Certification

Facilities meeting the applicable certification requirements may be awarded FEA Certification according to the final assessment score.

Certification levels may include:

  • Platinum Certification — 90% to 100%
  • Gold Certification — 80% to 89%
  • Silver Certification — 70% to 79%
  • Bronze Certification — 60% to 69%
  • Below 60% — Not Certified

Certification Validity

Unless otherwise specified in the applicable certification documentation, FEA Certification is valid for one year from the date of issue.

Facilities are encouraged to undergo reassessment periodically to maintain their certification and demonstrate continued performance.

Certification Use

Certified facilities may use the FEA certification mark or certificate only in accordance with the applicable certification guidelines provided by FEA.

Certification marks must not be used in a manner that is misleading, deceptive or suggests certification of products, services or activities outside the approved certification scope.

Fees and Payments

Fees for assessment, reporting, certification, reassessment or other services shall be communicated to the client before commencement of the applicable service.

Unless otherwise agreed in writing, applicable taxes, travel expenses, accommodation and other approved assessment-related expenses may be payable by the client.

Cancellation and Rescheduling

Requests to cancel or reschedule an assessment should be communicated to FEA as early as reasonably possible.

Any applicable cancellation, rescheduling or administrative charges shall be communicated as part of the applicable engagement or service terms.

Reports and Intellectual Property

Assessment reports, methodologies, frameworks, scoring systems, templates, forms, documents, graphics, branding, certification marks and other materials created or provided by FEA remain the intellectual property of their respective owners unless otherwise agreed in writing.

Clients may use their assessment reports for legitimate internal and agreed business purposes, subject to any confidentiality or usage restrictions.

Confidentiality

FEA will take reasonable measures to maintain the confidentiality of client information obtained during the assessment process, subject to applicable law and agreed contractual conditions.

Confidential information may be disclosed where required by law, regulatory authorities, legal proceedings or other applicable obligations.

Suspension or Withdrawal

FEA may suspend, withdraw or refuse certification where applicable requirements are no longer met, information provided is found to be materially inaccurate, certification is misused, or other applicable certification conditions are breached.

Limitation of Responsibility

FEA provides assessment and certification services based on the applicable methodology and information available during the assessment.

FEA Certification does not guarantee that a facility will remain compliant, safe, operational or free from incidents following completion of an assessment.

Facility management remains responsible for the operation, maintenance, safety, statutory compliance and risk management of the facility.

Third-Party Links and Services

The FEA website may contain references or links to third-party websites, resources or services.

FEA does not control and is not responsible for the availability, content, accuracy, privacy practices or policies of third-party websites.

Changes to These Terms

FEA may update or modify these Terms & Conditions from time to time to reflect changes in services, processes, legal requirements or business practices.

The updated version will become effective when published on this website unless otherwise specified.

Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the applicable laws of India, unless otherwise agreed in a written contract between FEA and the client.

Any disputes shall be subject to the jurisdiction of the courts or authorities specified in the applicable agreement or, where no specific agreement exists, the competent courts having jurisdiction over the relevant matter.

If any provision of these Terms & Conditions is determined to be invalid, unlawful or unenforceable, the remaining provisions shall continue to remain in effect to the extent permitted by law.
